This Hospital Breach
Breach Description
The Mason Tenders’ District Council Welfare Fund, along with its Pension Fund and Annuity Fund, experienced a significant data breach that occurred from December 2021 through April 2022. This incident led to a class action lawsuit, Vandermark, et al. v. Mason Tenders’ District Council Welfare Fund, et al., Index No. 153365/2023, which alleged that the breach potentially exposed personal identifying information (PII) and protected health information (PHI) of the plaintiffs and class members. The lawsuit claimed that as many as 20,000 people were affected and criticized the Mason Tenders’ District Council for failing to implement and maintain reasonable security measures, allowing hackers to have “unfettered access” to the organization’s computer system for nearly five months
The Mason Tenders’ District Council is a labor organization based in New York, serving over 17,000 members, including construction workers, asbestos and hazardous materials handlers, Catholic high school teachers, and recycling and waste handlers
The sensitive information accessed during the breach included names, Social Security numbers, dates of birth, medical information, and health insurance information
In response to the lawsuit, a settlement was reached, providing cash reimbursement payments to class members who submitted valid claims for up to $450.00 for documented ordinary out-of-pocket expenses or losses incurred due to the Data Incident, up to $2,500.00 for documented extraordinary out-of-pocket expenses or losses, and up to $60.00 for reimbursement for time spent responding to the Data Incident
Additionally, the settlement offered one year of identity protection and credit monitoring services for all class members who timely enrolled
The final approval hearing for the settlement took place on October 11, 2023
