Where it stands
As of October 12, 2026
As of the JPML's August 3, 2026 report, 6,294 actions were pending before Judge Rodgers. Court orders report that leadership counsel announced on June 15, 2026 a settlement of a majority of MDL and New York state-court claims, a private Master Settlement Agreement was signed in July 2026, and the court appointed a settlement administrator (CMO 13, August 5, 2026), qualified settlement fund administrator and lien resolution master (CMOs 15–17, September 4, 2026). CMO 14 (August 10, 2026) stays most MDL proceedings while setting a schedule for non-settling, not covered by the settlement and future-filed 'Litigating Plaintiffs,' and sets an initial bellwether trial for December 7, 2026 'subject to decisions on Defendants' preemption and Rule 702 motions.' The court is not a class action and is not reviewing the private settlement for fairness; who is covered is defined by the agreement, not by the court.[7]
The complaint
What is alleged, and what is not decided
Plaintiffs allege, in the words of the JPML transfer order, that 'they developed an intracranial meningioma caused by use of Depo-Provera or a generic version thereof.' The complaints claim the manufacturers failed to warn of a meningioma risk. Depo-Provera was approved by FDA as an injectable contraceptive in 1992. Nothing in the court record establishes liability or causation; the court has not ruled on the pending preemption and general-causation motions as of the latest orders opened.

What the regulators and the court have said
- 01
The current US Depo-Provera CI label (Pharmacia & Upjohn, openFDA set 199cf13e-0859-4a73-9b45-e700d0cd1049, version 29, effective 2026-08-25) lists a Recent Major Change 'Warnings and Precautions, Meningioma (5.4) 12/2025' and states in section 5.4: 'Cases of meningiomas have been reported following repeated administration of medroxyprogesterone acetate, primarily with long term use. Monitor patients on Depo-Provera CI for signs and symptoms of meningioma. Discontinue Depo-Provera CI if a meningioma is diagnosed.' This is a US (FDA) label fact, not only an EU/EMA change.[9]
- 02
The same label's Patient Counseling section directs clinicians to 'Counsel patients with a history of meningioma about the possible risk of worsening meningioma [see Warnings and Precautions (5.4)].'[9]
- 03
The court's Pretrial Order 30 recites that 'On December 12, 2025, the FDA approved a meningioma warning for the U.S. Depo-Provera label.'[4]
Timeline
How the case has moved
JPML centralizes 27 actions from eight districts in the Northern District of Florida before Judge M. Casey Rodgers; 41 potential tag-along actions noted.[1]
Pretrial Order 17 requires every plaintiff to provide 'initial documentary proof of use for each named Defendant's product' and 'initial documentary proof of their alleged meningioma injury' within 120 days.[3]
Defendants move for summary judgment on federal preemption; initial argument heard September 29, 2025 (as recited in PTO 30).[4]
FDA approves a meningioma warning for the US Depo-Provera label (as recited in PTO 30); the court orders supplemental preemption briefing through February 27, 2026.[4]
PTO 30: court states it 'intends its rulings on Defendants' preemption and Rule 702 motions to apply to all cases in the MDL,' not just the five Pilot Cases.[4]
CMO 11: preemption motion 'fully briefed and under review'; general-causation expert depositions February 28–March 20, 2026; Rule 702 briefing to conclude May 29, 2026.[5]
CMO 12 records that a settlement of a majority of MDL and New York claims was announced June 15, 2026 and a confidential Master Settlement Agreement signed July 21, 2026; court creates an administrative docket for claims review.[6]
CMO 14 stays most MDL proceedings, sets obligations and schedule for Litigating Plaintiffs (non-settling, not covered by the settlement, future-filed), and sets an initial bellwether trial for December 7, 2026 subject to preemption/Rule 702 rulings.[7]
If this involves you
The records that matter, and who has them.
Whatever you decide to do next, you will be asked for these. They are yours by law, and most providers have up to 30 days to send them once they have your signed request.
Injection administration records / immunization-medication administration log
Depo-Provera is given in a clinic every ~3 months; these records are the primary 'proof of use' the court requires for each defendant's product, including brand vs. generic
Held by: OB-GYN, family-planning clinic, Planned Parenthood, student health, county health department
Pharmacy and PBM records
PTO 17 names 'prescription, medical insurance, and pharmacy records' for plaintiffs lacking definitive product identification (which manufacturer's product was used)
Held by: pharmacy, PBM, health plan
Brain MRI / CT imaging reports and images
document the meningioma diagnosis, size and location; CMO 14 requires 'all available records of their meningioma diagnosis, treatment'
Held by: hospital radiology department, imaging center
Neurosurgery / neurology records and pathology report
confirm diagnosis (and WHO grade if resected), treatment and ongoing injury
Held by: neurosurgeon, hospital HIM department, pathology lab
Records under all prior names
CMO 11 notes many proof-of-use deficiencies 'could be avoided if plaintiffs provide MDL Centrality all names that the plaintiff has used in the past' because medical records often reflect a prior name
Held by: patient (to supply to counsel/records custodians)
Health insurance claims history
independent corroboration of injection dates and diagnosis dates
Held by: health plan / Medicaid agency
We send the request, follow up with the provider, and deliver the records to you. We don't take case details here and we never share your records with a law firm unless you tell us to.
Questions people ask
Straight answers, with sources
Is the Depo-Provera meningioma lawsuit real?
Yes. The JPML created MDL No. 3140 on February 7, 2025, centralizing federal cases in the Northern District of Florida before Judge M. Casey Rodgers. As of the JPML's August 3, 2026 report, 6,294 actions were pending.[8]
Has the case settled?
Court orders state that leadership counsel announced a settlement of a majority of MDL and New York state-court claims on June 15, 2026 and signed a private Master Settlement Agreement in July 2026. The court notes the MDL is not a class action, it is not reviewing the agreement for fairness, and who is covered is defined by the agreement. Cases that are not part of the settlement continue under CMO 14.[6]
Does the US FDA label now warn about meningioma?
Yes. The current Depo-Provera CI label (effective August 25, 2026, per openFDA) shows a Warnings and Precautions section 5.4 'Meningioma' added 12/2025, stating that meningiomas have been reported following repeated administration, primarily with long-term use, and that the drug should be discontinued if a meningioma is diagnosed.[9]
What records does the court require from people in the MDL?
Pretrial Order 17 requires 'initial documentary proof of use for each named Defendant's product' and 'initial documentary proof of their alleged meningioma injury.' CMO 14 requires Litigating Plaintiffs to provide all available documents showing product use with first/last-use dates, and all available records of the meningioma diagnosis and treatment.[7]
Are there related cases in state courts?
Yes. CMO 12 (July 27, 2026) reports coordinated state-court litigation including 129 cases in New York, 410 in Delaware and 118 in California, with smaller groups in Connecticut, Minnesota, Illinois and other states.[6]
