These Terms of Service ("Terms") govern your access to and use of MedicalRecords.com ("we," "us," "our") website, services, and applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not access or use our Services.
Services Description
MedicalRecords.com provides:
- Medical records retrieval and delivery services
- Healthcare information and resources
- EMR software comparison and research tools
- Hospital and doctor directory services
- Healthcare guides and educational content
Eligibility
You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet this age requirement.
Parents, legal guardians, and other personal representatives may use our Services on behalf of another person when authorized by law. For a records request, contact support so we can document that authority before the request is sent to a provider.
User Accounts
Account Creation
To access certain features, you may need to create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access
- Be responsible for all activity under your account
Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.
Medical Records Services
Authorization
By using our medical records retrieval services, you authorize us to:
- Contact healthcare providers on your behalf
- Request and receive your medical records
- Pay applicable fees to healthcare providers
- Deliver records to you electronically or by mail
Processing Time
Provider response and delivery timing varies. For requests that qualify for the HIPAA right of access, a covered entity generally must act no later than 30 calendar days after receipt and may take one additional 30-day extension after giving the individual a written explanation and completion date. Other request types, state laws, and provider processes may differ. Our service tier changes our dispatch and follow-up handling; it does not change a provider's legal deadline or guarantee release by a particular date. See the HHS right-of-access guidance.
Fees
Our service fees are disclosed before you place an order. Fees may include:
- Service fees for our records retrieval services
- Healthcare provider fees (varies by state and provider)
- Shipping and handling fees (if applicable)
Service fees are generally non-refundable once we have submitted your request to the healthcare provider, except where a written checkout term expressly provides otherwise or applicable law requires a refund. Provider-assessed copying, media, certification, postage, and delivery fees are not refundable by MedicalRecords.com.
User Conduct
You agree NOT to:
- Provide false or misleading information
- Impersonate another person or entity
- Use the Services for illegal purposes
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Services
- Harvest or collect user information
- Use automated systems (bots, scrapers) without permission
- Violate any applicable laws or regulations
Intellectual Property
Our Content
All content on our Services, including text, graphics, logos, images, software, and data compilations, is owned by or licensed to MedicalRecords.com and protected by copyright, trademark, and other intellectual property laws.
Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes. This license does not include:
- Resale or commercial use of the Services
- Copying, reproduction, or distribution of content
- Modification or derivative works
- Use of data mining or extraction tools

Service Availability

Third-Party Content
We are not responsible for the accuracy, completeness, or reliability of third-party content, including healthcare provider information, EMR system data, or linked websites.
Limitation of Liability
To the maximum extent permitted by law, MedicalRecords.com and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
- Your use or inability to use the Services
- Unauthorized access to your data
- Errors, mistakes, or inaccuracies in content
- Delays or failures in medical records retrieval
- Actions taken based on information from our Services
Our total liability to you for all claims shall not exceed the amount you paid us in the 12 months prior to the claim, or $100, whichever is greater.
Indemnification
You agree to indemnify and hold harmless MedicalRecords.com from any claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your provision of false or misleading information
Dispute Resolution
Informal Resolution
If you have a dispute with us, please contact us first at support@medicalrecords.com to attempt an informal resolution.
Arbitration
Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except as modified by these Terms.
Class Action Waiver
You agree that any arbitration or legal proceeding shall be conducted on an individual basis, not as a class action or representative action.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a new "Last Updated" date.
Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.
Severability
